BURKE, Justice. RSB Investment Fund II, Ltd. ("RSB") alleges inverse condemnation of its property by the Municipality of Anchorage ("Municipality").
The questions presented are whether the Municipality's designation of RSB's property as "conservation wetlands" constituted
a regulatory taking, and whether the Municipality's construction of the North Klatt Road Extension resulted in a physical
invasion of RSB's property. The superior court granted the Municipality's partial summary judgment motion 1 on the regulatory
takings question, holding that the "conservation wetlands" designation did not amount to an inverse condemnation of RSB's
property. A jury determined that no physical taking occurred as a result of the construction of the North Klatt Road Extension.
We affirm both the superior court's grant of partial summary judgment and the jury's verdict.
